FAQ's - Mortgage Claims

 

  1. What is mortgage mis-selling?
    Mortgage mis-selling is not a legal term, it is a way to include all the potential breaches or and misrepresentations by any of the parties involved in the mortgage.
  2. Will I be 'blacklisted' by the lender if I make a claim?
    If you make a claim against any company then, under 'treating customers fairly' rules, you should not be treated any differently to any other client.
  3. Can a review be perfomed on a mortgage product that I no longer have?
    We will perform product reviews on mortgages, even when you have remortgaged or paid the mortgage.
  4. What does the fee cover?
    The fee covers all aspects of our work including legal representation.

 

 

  1. What if the case is settled out of court?
    When a case is settled in your favour out of court and any fees become payable, these would be met by the lender and not yourselves.
  2. Is there an alternative to using Unfair Credit Direct?
    Yes, you could try and deal with the lender yourself or use alternative schemes. However it is unlikely your lender will settle without the threat of legal action, which can be very costly. You could also seek assistance from organisations such as the Citizens Advice Bureau or the Financial Ombudsman Services.
